Introduction.

These Moxie Payment Terms ("Terms") govern the use of Moxie Payment Rails ("Service") provided by Moxie ("we", "us", or "our"). By using the Service, you ("Merchant" or "you") agree to these Terms.

Payment Terms.

1. Payment Processing: We process payments on behalf of Merchants, facilitating transactions between buyers and sellers.

2. Payment Methods: We support various payment methods, including:

    - Card payments (Visa, Mastercard, Amex, Discover, JCB, Diners Club)

    - Bank transfers (ACH, SEPA, EFT, Bank Wire, SWIFT)

    - Mobile money (M-Pesa, MTN, Airtel, Glo, Orange Money)

    - Cryptocurrencies (Bitcoin, Ethereum, Litecoin, USD Coin)

    - Virtual cards (Virtual NGN Debit Card, Virtual USD Debit Card)

3. Transaction Fees: Merchants pay transaction fees between 1.5% - 3.5% + $0.30 per transaction.

4. Monthly Fees: Merchants pay monthly fees ranging from $0 - $50, depending on transaction volume.

5. Settlement: We settle transactions in real-time or within two (2) business days (T+2), depending on the payment method and merchant configuration.

6. Refunds: Merchants are responsible for processing refunds and chargebacks.

7. Chargebacks: Merchants are liable for chargebacks and disputes.

Payment Security

1. PCI-DSS Compliance: We maintain PCI-DSS Level 1 Compliance ¹.

2. Data Security: We implement robust data security measures, including encryption and secure data storage.

3. Fraud Detection: We use fraud detection tools to prevent unauthorised transactions.

Merchant Obligations.

1. Compliance: Merchants must comply with applicable laws, regulations, and industry standards.

2. Transaction Monitoring: Merchants must monitor transactions for suspicious activity.

3. Customer Support: Merchants must provide customer support for transactions.

Dispute Resolution.

1. Dispute Process: We resolve disputes in accordance with our dispute resolution policy.

2. Chargeback Resolution: Merchants must resolve chargebacks and disputes in a timely manner.

Termination.

1. Termination: We reserve the right to terminate these Terms upon written notice.

2. Effect of Termination: Upon termination, all rights and obligations cease, except for those surviving termination.

Limitation of Liability.

1. Liability Limitation: Our liability is limited to direct damages.

2. Indemnification: Merchants indemnify us against third-party claims.

Governing Law.

1. Governing Law: These Terms are governed by and construed in accordance with the laws of Canada.

2. Jurisdiction: Any disputes arising out of or related to these Terms shall be resolved through the courts of Canada.

Entire Agreement.

These Terms constitute the entire agreement between you and us.

Amendments.

We reserve the right to amend these Terms upon written notice.
